Welcome to Farmer J’s privacy notice (“Privacy Notice”). Farmer J respects your privacy and is committed to protecting your Personal Data. This Privacy Notice explains how Farmer J Limited (“Farmer J”, “we”, “us” or “our”) collects and processes your Personal Data (defined below) when you visit https://www.farmerj.com/ (our “Website”), use the Farmer J mobile application (our “App”), join or use the Club Fork loyalty programme (“Club Fork”), place orders online or via the App, visit one of our Farmer J restaurants, or otherwise interact with us. It also tells you about your privacy rights and how the law protects you.

We keep our Privacy Notice under regular review. Any changes we make to this Privacy Notice in the future will be published on the Website and, where appropriate, notified to you via the App. The date at the top of this page will show when the Privacy Notice was last updated. Please check back frequently for updates. It is important that the Personal Data we hold about you is accurate and current. Please let us know if your Personal Data changes during your relationship with us so that we can keep our records up to date.

Clicking on those links or enabling connections to third-party services may allow third parties to collect or share data about you. We do not control these third-party websites and applications or take responsibility for their privacy practices.   1. THE DATA WE COLLECT ABOUT YOU

Personal Data” means any information relating to an identified or identifiable natural person: an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, online identifier or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity. It does not include data that has been anonymised so that you can no longer be identified from it.

We may collect, use, store and transfer different categories of Personal Data about you, which we have grouped together as follows:

  • Identity Dataincludes first name, last name, title, username, date of birth.
  • Contact Dataincludes billing address, delivery address, email address, and telephone numbers.
  • Financial Dataincludes bank account, payment card details and tax information. Information relating to payments may be handled by our payment providers. Farmer J does not store your full payment card details within the App.
  • Transaction Data includes details about your orders, purchases and transaction history (including orders placed via the Website, the App or in our restaurants), Forks collected, rewards earned or redeemed, and your reward history.
  • Technical Dataincludes internet protocol (IP) address, your login data, browser type and version, time zone setting, operating system, device type and other technology on the devices you use to access the Website or the App.
  • Profile Data includes your account authentication information, your Club Fork account details (including membership status), your interests, preferences, feedback and survey responses, and any queries, comments or complaints you send us.
  • Usage Dataincludes information about how you use the Website, the App and our services, including app usage data and browsing patterns.
  • Marketing and Communications Data includes your preferences for receiving marketing from us and third parties, and your communication and App notification preferences.
  • Location Data includes your geographic location where you enable location services on your device.

We do not generally collect or seek to collect any Special Categories of Personal Data about you. If you provide us with Special Categories of Personal Data, we will only process it where permitted by applicable data protection laws. We do not generally collect any information about criminal convictions and offences.

IF YOU FAIL TO PROVIDE PERSONAL DATA

Where we need to collect Personal Data by law or under the terms of a contract we have with you (including the Club Fork membership terms), and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services, or to operate your Club Fork account). In some cases, this may mean that we are unable to provide you with the product, service or membership you have requested, but we will notify you if this is the case at the time.

  1. HOW IS YOUR PERSONAL DATA COLLECTED?

We use different methods to collect data from and about you including through:

  • Direct interactions.You may give us your Identity, Contact, Transaction, Financial, Technical, Profile, and Marketing and Communications Data when you correspond with us by post, phone, email, the App or otherwise. This includes Personal Data you provide when you:
    • create a Farmer J or Club Fork account;
    • place an order via the Website, the App or in one of our restaurants;
    • subscribe to our newsletter or other communications;
    • give us feedback or contact us. If the communication relates to an error or problem you are having with the App, we will also collect Usage Data for diagnosis and improvement;
    • participate in a promotion, competition or survey; or
    • request marketing to be sent to you.
  • Information you generate when using our App. When you access and use our App, we may collect Transaction, Technical, Profile, Usage and Location Data.
  • Automated technologies or interactions.As you interact with our Website or App, we will automatically collect Technical, Usage and Location Data about your equipment, browsing actions and patterns. Where you provide your consent, we collect your Location Data while you have the App installed on your device. We collect this data by using cookies, server logs, device identifiers and other similar technologies.
  • Direct Marketing. We collect Marketing and Communications Data when we add you to our marketing database, you request to change your direct marketing preferences, or you interact with our direct marketing communications.
  • Third parties or publicly available sources.We may receive Personal Data about you from various third parties, including: (a) Technical Data from analytics providers; (b) Contact, Financial and Transaction Data from providers of our technical, payment and delivery services, and (c) Identity and Contact Data from our business partners.
  • We use cookies (small files placed on your device) SDKs, device identifiers and similar tracking technologies on the Website and App to collect Usage and Technical Data and improve your experience.   1. HOW WE USE YOUR PERSONAL DATA

We will only use your Personal Data where we have a lawful basis to under applicable data protection law. The lawful bases we may rely on include:

  • Where we need to perform the contractwe are about to enter into or have entered into with you.
  • Where it is necessary for our legitimate interests(or those of a third party) and your interests and fundamental rights do not override those interests. Note that there are also recognised legitimate interests under UK data protection law which include public interest reasons for processing (such as preventing or detecting crime, safeguarding individuals, or sharing information with public bodies when they confirm it is necessary for their official functions).
  • Where we need to comply with a legal obligation, for example we may process your Identity, Contact, and Financial Data to comply with laws on money laundering prevention and crime or financing terrorism processes.
  • Where you have given your consent.

Generally, we do not rely on consent as a legal basis for processing your Personal Data although we will obtain your consent before sending direct marketing communications to you via email, SMS or App notification. You have the right to withdraw consent to marketing at any time by contacting us at hello@farmerj.com, by using the unsubscribe link in our communications, or by adjusting your preferences in the App.

We have set out below a description of all the ways we plan to use your Personal Data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate. Note that we may process your Personal Data for more than one lawful ground depending on the specific purpose for which we are using your data.

  1. MARKETING AND NOTIFICATIONS

We may send you marketing communications about Farmer J news, products, offers and promotions through channels such as email, SMS or App notifications where we are permitted to do so under applicable law. Where required, we will ask for your consent before sending you marketing communications. In certain circumstances, we may be able to send marketing communications to existing customers where permitted by applicable law and where you have been given an opportunity to opt out.

We will not share your Personal Data with third parties for their own direct marketing purposes unless we have a lawful basis to do so and, where required, have obtained your consent.

OPTING OUT

You can ask us to stop sending you marketing communications at any time by following the unsubscribe or opt-out instructions included in our marketing message, by adjusting your preferences in the App or your device settings, or by contacting us at hello@farmerj.com. We may however still contact you with important service messages relating to the App, your account, orders or Club Fork membership.

CHANGE OF PURPOSE

We will generally only use your Personal Data for the purposes for which we collected it, unless we reasonably consider that a new purpose is compatible with the original purpose. If you would like an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. If we need to use your Personal Data for a purpose that is not compatible with the original purpose, we will notify you and we will explain the legal basis for doing so. Where required by law, we will obtain your consent before carrying out the further processing.

  1. DISCLOSURES OF YOUR PERSONAL DATA

We may share your Personal Data with the parties set out below, for the purposes set out in the table above:

  • Business partners who support us in providing our products, services and Club Fork benefits where doing so is necessary for the performance of our contractual relationship with you
  • Service providers who provide Farmer J with IT and system administration services, hosting services for our App, delivery and logistics services, data analytics and payment processing
  • Professional advisers including lawyers, bankers, auditors and insurers
  • HM Revenue & Customs (United Kingdom), regulators and other authorities
  • any third parties to whom we may choose to sell, transfer or merge parts of the Farmer J business or assets

We require third parties that process Personal Data on our behalf to respect the security of your Personal Data and to process it in accordance with the law. Where a third party acts as out data processor, we require it to process your Personal Data only for specified purposes and in accordance with our instructions.

  1. INTERNATIONAL TRANSFERS

We may share your Personal Data with partners outside of the UK and European Economic Area (“EEA”), when doing so is necessary for the purposes mentioned in this Privacy Notice. Whenever we transfer Personal Data out of the UK or EEA, we ensure that appropriate safeguards are in place in accordance with applicable data protection laws. Please contact us if you want further information on the specific transfer mechanism.

  1. DATA SECURITY

We have put in place appropriate technical and organisational security measures to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your Personal Data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Data on our instructions and they are subject to a duty of confidentiality.

Where we have given you (or where you have chosen) a password that enables you to access certain parts of our App or Club Fork, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

We have procedures in place to deal with any suspected Personal Data breach and will notify you and any applicable regulator of a breach if we are legally required to do so.

  1. DATA RETENTION

We will only retain your Personal Data for as long as reasonably necessary to fulfil the purposes we collected it, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Data for a longer period in the event of a complaint or dispute or if we reasonably believe there is a prospect of litigation in respect of our relationship with you.

To determine the appropriate retention period for Personal Data, we consider the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorised use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

When we no longer need your Personal Data, we will delete or anonymise it as appropriate.

  1. YOUR LEGAL RIGHTS

Under certain circumstances, you have rights under data protection laws in relation to your Personal Data. If you wish to exercise any of your legal rights, please contact us using the contact details set out in this Privacy Notice.

You have the right to:

  • Request access to your Personal Data. This enables you to receive a copy of the Personal Data we hold about you and to check that we are lawfully processing it.
  • Request correction of the Personal Data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no lawful basis for us continuing to process it. Note, however, that we may not always be able to comply with your request for erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your Personal Data where we are relying on a legitimate interest (or those of a third party) and there is something about your situation which you wish us to consider. In some cases, we may continue to process your Personal Data if we can demonstrate that we have compelling legitimate grounds which override your rights and freedoms, or where the processing is necessary for the establishment, exercise or defence of legal claims. You also have an absolute right to object where we process your Personal Data for direct marketing purposes. If you object to direct marketing, we will stop processing your Personal Data for those purposes.
  • Request restriction of processing of your Personal Data. This enables you to ask us to suspend the processing of your Personal Data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; and (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your Personal Data to you or to a third party. We will provide to you, or a third party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Note that this right only applies to information processed by automated means which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your Personal Data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
  • Complain to us if you are unhappy with how we handle your Personal Data, please contact us first using the details above so that we have the chance to put it right. If we receive a complaint, we will: (a) acknowledge receipt within 30 days of receiving it; (b) without undue delay, take appropriate steps to respond to your complaint, including making appropriate enquiries with any persons involved; (c) keep you informed of the progress of your complaint; and (d) tell you the outcome of your complaint once we have considered it.
  • Complain to the data protection regulator. If you are in the United Kingdom, this is the Information Commissioner (ico.org.uk). If you are in the European Union, you may lodge a complaint with your local supervisory authority. We would, however, appreciate the chance to deal with your concerns before you approach the relevant authority, so please contact us in the first instance.

NO FEE USUALLY REQUIRED

You will not have to pay a fee to access your Personal Data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is manifestly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances. We will notify you if this is the case at the time

WHAT WE MAY NEED FROM YOU

We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Data (or to exercise any of your other rights). This is a security measure to ensure that Personal Data is not disclosed to any person who has no right to receive it.

TIME LIMIT TO RESPOND

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
